The wife of a man who won $273 million in the Mega Millions lottery earlier this month is asking him to end her court-ordered spousal support. Eileen Murray was the primary breadwinner during her marriage to Mike Weirsky of Alpha, New Jersey. They just divorced months ago, and Murray was ordered to pay spousal support for five years, but she's hoping his massive windfall will change things. "To him, [the alimony] is pocket change at this point," Murray told Inside Edition. #InsideEdition

So, what is spousal support? Spousal support, which is often called alimony, is money paid from one spouse to another after a divorce. The idea of alimony is to maintain the lifestyle that the other spouse enjoyed during the relationship.
Spousal support applies to men and women equally. So, if the husband was making more than the wife, he may have to pay spousal support and vice versa, a wife may have to pay spousal support to her husband.

If you are getting a divorce, and you need alimony, don’t panic! All states have laws to help you. In this video I guide you through the 3 most important matters you need to focus on when you are fighting for alimony.
1. Learn the law in your state – A lawyer is always a great option when facing a legal challenge. A good mediator, too, will be able to tell you how the alimony laws work in your state.
2. List your expenses – Don’t let your emotions effect the numbers. Use real expenses. Where you don’t know exactly what your future expenses will be, use reasonable projections. Don’t pad your numbers; but don’t be too skimpy, either.

Here’s a dirty word: “alimony.” Alimony has a nasty reputation as a device that enslaves men and demeans women—preventing divorced men from beginning new lives, and perpetuating female dependence on men. Alimony, it is said, has no place in an era of egalitarian marriage. That it survives is something of a mystery, and surely the day is not too far away when alimony will take its rightful place in the contemporary trash heap reserved for antiquated remnants of an unenlightened, gender-biased age.
The truth about alimony is very different. Alimony is gender-neutral (and must be, said SCOTUS in 1979), it is uncommon, and when awarded, it is usually short-term and freely modifiable. Indeed, the term “permanent” alimony is a misnomer, and the concept of lifetime enslavement an exaggeration. To be sure, outlier cases exist (check out the horror stories on Alimony Reform Group websites, but be suspicious), but in general, alimony’s propensity to bind cuckolded men to country club wives is myth.
As for the charge that alimony demeans women, actually the opposite is true—alimony ensures that women are treated as equal partners in marriage rather than suckers. In most homes, especially those with children, one partner serves as the primary family caregiver, a role that frees the other spouse to make a more concerted investment in a job or career. Primary caregiving is ubiquitous and primary caregivers are overwhelmingly female. While caregiving confers value on the family, it is not free for the caregiver: caregiving is commonly associated with a decline in earnings and ultimately in earning capacity. While the family is intact, these costs are shared and masked, but if the parties divorce, they are abruptly exposed. When marital property is scant, as it is in most marriages, alimony is the only tool for ensuring that divorcing spouses share, as equal partners, the human capital costs and benefits of family roles.
All this is why I am surprised by a recurring question, “How can you be a feminist and support alimony?” Maybe those who ask this question haven’t heard of Terry Hekker, the stay-at-home mom of five whose husband announced on their 40th wedding anniversary that he wanted a divorce. Long story short, Terry got four years of alimony, a suggestion from a divorce judge that she undertake job retraining at age sixty-seven, and a notice from the IRS that she qualified for food stamps. Meanwhile, her former husband vacationed in Cancun with his girlfriend.
Terry Hekker was thrown under the bus at divorce—and not respectfully. Her fate is a feminist issue and it is an issue, as one court said long ago, “of ordinary common sense, basic decency and simple justice.”
When I teach the economic consequences of divorce, I sometimes begin with the lovely voices of Ella Fitzgerald and Louis Armstrong singing Irving Berlin’s classic: “I’m putting all my eggs in one basket. God help me if my baby don’t come through.” The unhappy truth is that some babies don’t come through; sometimes they change their minds and leave, and sometimes they take all the family eggs with them. Alimony is nothing more than a tool for ensuring that partnership eggs are shared.

So, what is spousal support? Spousal support, which is often called alimony, is money paid from one spouse to another after a divorce. The idea of alimony is to maintain the lifestyle that the other spouse enjoyed during the relationship.
Spousal support applies to men and women equally. So, if the husband was making more than the wife, he may have to pay spousal support and vice versa, a wife may have to pay spousal support to her husband.
Spousal support is not guaranteed in Illinois. But every state is different. So I encourage you to look at your state’s laws on alimony.
What are the factors in determining alimony? The factors in Illinois to look to determine whether a spouse will have to pay alimony include:
What are the spouses’ current income?
What is their potential income?
How much non-marital property does the spouse seeking support have?
How much marital property will the spouse seeking support get in the divorce?
So hypothetically, if the spouse seeking support has a lot of money, it is very possible that the other spouse will not have to pay spousal support.
Also, if both parties make similar income, it is likely that neither spouse will have to pay spousal support.
But things are changing in this field as women continue to make more and more money. But there is a classic alimony situation that Mark still sees:
A young couple gets married with no kids, then they have kids and the wife stays home to raise them. The husband is in the work force and advances and continues to make more and more money.
The wife meanwhile remains at home, does not have a job and does not advance her career and/or make more and more money.
In this “traditional” spousal support situation, the husband pays spousal support.
How long does spousal support go on for? Does alimony go on forever?
The answer is, it depends on the laws of the state you are in.
In Illinois, there is a table that determines how long spousal support goes on for. Very generally speaking, if the marriage lasted 5 years or less, then a spouse will be entitled to 20% of the time of the marriage in alimony – or one year.
If the marriage lasted 15 or 16 years etc., then the spouse might be entitled to 80 or 90% of the marriage in years of support.
After 20 years, the court might award 100% of the time of the marriage in support, or 20 years. The court may also award support indefinitely.
Is spousal support modifiable? In Illinois spousal support is modifiable upon a substantial change in circumstances. Meaning, if the spouse receiving spousal support gets a job and ends up making a lot of money, the spouse paying support might petition to have the support payment reduced.
Also, losing a job might be grounds for modifying spousal support as well.
Is alimony avoidable? It might be. In Illinois you can agree in a divorce decree that spousal support is non-modifiable. In that case, it may stick no matter what happens.
Are there alternatives to paying spousal support? There are. The parties in Illinois can enter into a “maintenance buyout” which provides the spouse a large chunk of money or property up front, thus terminating the obligation for spousal support.
Are there times when spousal support might end sooner than expected? There are. For example, if one of the parties dies in Illinois, that will terminate the payments.
And again if one spouse gets a great paying job, then spousal support may no longer be needed.
Finally, in Illinois, if one spouse starts cohabitating with a significant other on a conjugal basis, meaning truly living together, that might be grounds to end alimony payments.

If you are getting a divorce, and you need alimony, don’t panic! All states have laws to help you. In this video I guide you through the 3 most important matters you need to focus on when you are fighting for alimony.
1. Learn the law in your state – A lawyer is always a great option when facing a legal challenge. A good mediator, too, will be able to tell you how the alimony laws work in your state.
2. List your expenses – Don’t let your emotions effect the numbers. Use real expenses. Where you don’t know exactly what your future expenses will be, use reasonable projections. Don’t pad your numbers; but don’t be too skimpy, either.
3. Be nice to your spouse – You won’t win your alimony negotiation being nasty. Now is the time to show some appreciation. Show your willingness to also contribute financially. Don’t get hung up in past transgressions and bad behavior.
