What data will be collected about you?

Kontent will use your personal data for the following purposes:
Use of the site
- In order to work properly, kontent.ai and its subdomains need to use cookies. - Processing of your data for this purpose is necessary for the purposes of the legitimate interest pursued by Kontent (within the meaning of sec. 6(1)(f) of the GDPR) to respond to the submitted queries, complaints, or feedback and to improve its products and services hereby. For this purpose, the data will be processed for the period necessary to deliver the response, maximally for the period of four years. You have no legal obligation to provide the data, nevertheless, in that case, Kontent will not be able to respond.
Ordering of Kontent’s products or services
- If you use kontent.ai or its subdomains to order any of Kontent’s products or services, Kontent will use the information you submit in the respective order form for the purposes of taking steps prior to entering into a respective contract.
- Processing of your data for this purpose is necessary to take steps prior to entering into a respective contract at your request within the meaning of sec. 6(1)(b) of the GDPR. For this purpose, the data will be processed during the performance of the contract, and maximally for the period of four years after its termination. When it becomes obvious that the contract will not be concluded, the data will be processed maximally for the period of four years. You have no legal obligation to provide the data, nevertheless, in that case, you will not be able to order any of Kontent’s products or services.
Contact and lead management
- Kontent monitors your activities on kontent.ai and its subdomains, collects data about your activities on kontent.ai and its subdomains, and uses collected data for profiling and lead scoring. Kontent may also match the collected data with other data that Kontent collects about you if you used Kontent’s products and services before or actively submit information about you to Kontent using kontent.ai or its subdomains, typically when you fill in a contact form. This will allow Kontent to improve the websites and services and to gather statistics about its usage. Kontent will also be able to show you more relevant and personalized content and prepare for you services, information, or offers more tailored to your needs.

- Processing of your data, which Kontent collects when you fill in a contact form, is based on your consent within the meaning of sec. 6(1)(a) of the GDPR. You have no legal obligation to provide the data, nevertheless, in that case, Kontent will not be able to respond or show you more relevant and personalized content and prepare for you services, information, or offers more tailored to your needs.
Kontent service
What data will be collected about you?
When you order the Kontent service or when you buy the Kontent service, Kontent will collect your data provided for the contract on the provision of the Kontent service (“Contract”) and in any other document made by you and Kontent in relation to the Contract, and your data provided during your registration to create an account to access the Kontent service. Furthermore, Kontent will collect other data which you provide to Kontent in relation to the performance of the Contract or the conclusion of the Contract. Collected data consist typically of contact details such as name, seat/residence, ID No./date of birth, e-mail address, and phone number, and invoicing details such as your bank account number.
How will Kontent use the data it collects about you and for what purposes?
Kontent will use your personal data for the following purposes:
Conclusion of the Contract
- If you contact Kontent for the purpose of ordering Kontent service, regardless of whether via kontent.ai or its subdomains or any other way, Kontent will use the information you provide to it for the purpose of taking steps prior to entering into the Contract.
- Processing of your data for this purpose is necessary to take steps prior to entering into the Contract at your request within the meaning of sec. 6(1)(b) of the GDPR. For this purpose, the data will be processed until the Contract is concluded, or until it becomes obvious that the Contract will not be concluded, the data will be processed maximally for a period of four years. You have no legal obligation to provide the data, nevertheless, in that case, you will not be able to conclude the Contract.
Provision of the service
- Kontent will use your data to perform its rights and obligations arising out of the Contract, especially for the provision of the Kontent service and invoicing, and for the creation of your account and its maintenance. Processing of your data for this purpose is necessary for the performance of the Contract within the meaning of sec. 6 (1)(b) of the GDPR.
- Kontent may use your data also to track and analyze (on anonymous basis) your use of the Kontent service in order to gather insights and improve the service. Processing of your data for this purpose is necessary for the legitimate interests pursued by Kontent within the meaning of the sec. 6(1)(f) of the GDPR.
- For these purposes, the data will be processed, at a maximum, until 90 days after the termination of all the respective contractual obligations, with the exception of data we reasonably require to protect our rights, where the data will be retained for 4 years after the termination of all contractual obligations. You have no legal obligation to provide the data, nevertheless, in that case, the Contract cannot be concluded and performed.

How will Kontent process personal data uploaded to Kontent?
- If you upload any personal data (especially personal data of third parties) to Kontent.ai, Kontent will process the data for you, according to your instructions, as a processor of such data. Kontent shall endeavor to secure the personal data uploaded to Kontent at a high level, always in accordance with the GDPR.
- Please note that you have to make sure the personal data are collected and uploaded to Kontent pursuant to the GDPR. Kontent is not liable for any claims arising out of the breach of this obligation.

Kontent.ai Partner Program
What data will be collected about you?
When you participate in the Kontent.ai Partner Program, Kontent will collect information you provide while registering for the Program, and further information which you provide Kontent with in relation to your participation in the Kontent.ai Partner Program. Collected data consist typically of contact details such as name, seat/residence, ID No./date of birth, e-mail address, website, and phone number.
How will Kontent use the data it collects about you, and for what purposes?
Kontent will use your personal data to perform its rights and obligations arising out of the Kontent.ai Partner Program.
Processing of your data for this purpose is necessary for the performance of the contractual obligations arising out of the Kontent.ai Partner Program within the meaning of sec. 6 (1)(b) of the GDPR. For this purpose, the data will be processed until the termination of all the contractual obligations arising out of your participation in the Kontent.ai Partner Program, maximally for a period of four years. You have no legal obligation to provide the data, nevertheless, in that case, you cannot participate in the Kontent.ai Partner Program.
Kontent.ai Partners and Suppliers
What data will be collected about you?
When you enter into a contractual relationship with Kontent.ai, Kontent.ai will use your personal information to perform its rights and obligations arising out of the contract. Collected data consist typically of contact details such as name, seat/residence, ID No./date of birth, e-mail address, website, and phone number.
How will Kontent use the data it collects about you, and for what purposes?
Kontent will use your personal data to perform its rights and obligations arising out of the contract.
Processing of your data for this purpose is necessary for the performance of the contractual obligations arising out of the contract within the meaning of sec. 6 (1)(b) of the GDPR. For this purpose, the data will be processed until the termination of all the contractual or legal obligations, maximally for a period of 5 years after the termination.
Marketing activities
What data will be used?
For marketing activities, Kontent uses only your basic contact details, typically name, seat/residence, e-mail address, and phone number. In case of sales calls we may record such calls which contain your personal information.
How will Kontent use the data?
Kontent will use your personal data for the marketing activities only with your explicit consent, regardless of whether given during your activities on the kontent.ai website or its subdomains.
If you give Kontent your consent for the processing of your data for marketing purposes, Kontent will use your contact details to send you marketing communications about Kontent’s products and services and about events organized by Kontent and news related to Kontent or its products or services, which you may find interesting, or otherwise contact you with these marketing communications.
In case you give your consent for a specific marketing activity only, for example, receiving the Kontent Newsletter, Kontent will use your data only for this specific marketing activity. Please note that you can always personalize the content you want to receive via the kontent.ai website using the page “Personalize Your Consent Settings”. In that case, Kontent will send you only the marketing communication according to your settings.
Processing of your data for this purpose is based on your consent within the meaning of sec. 6 par. 1 letter a) of the GDPR. Your personal data will be used only for the duration of your consent. You may withdraw the consent anytime simply by clicking on the appropriate button on the footer of any marketing communication, or via the kontent.ai website using the page “Personalize Your Consent Settings”. You have no legal obligation to provide the data.
Marketing activities for clients
What data will be used?
For marketing activities, Kontent uses only your basic contact details, typically name, seat/residence, e-mail address, and phone number.
How will Kontent use the data?
Kontent will use your personal data for the marketing activities. Kontent will use your contact details to send you marketing communications about Kontent’s products and services and about events organized by Kontent and news related to Kontent or its products or services, which you may find interesting, or otherwise contact you with these marketing communications. Kontent will use your contact details also for advertising purposes in the services of third-party platforms.
Please note that you can always personalize the content you want to receive via the kontent.ai website using the page “Personalize Your Consent Settings”. In that case, Kontent will send you only the marketing communication according to your settings.
Processing of your data for this purpose is necessary for the purposes of the legitimate interest pursued by Kontent (within the meaning of sec. 6(1)(f) of the GDPR) to inform you about Kontent’s products and services and about events organized by Kontent and news related to Kontent or its products or services, which you may find interesting. You may withdraw the consent anytime simply by clicking on the appropriate button on the footer of any marketing communication, or via the kontent.ai website using the page “Personalize Your Consent Settings”. You have no legal obligation to provide the data.
Processing of your data gathered from sales call recordings is carried out based on individual consent in the meaning of sec. 6(1)(f) of the GDPR. The call recordings are used to improve the quality of our services and will be kept no longer than strictly necessary and at maximum for one month after their collection. You can revoke you consent at any time during or after the recorded call and you have the right to access the recording and request its deletion at any time as is described in “Your rights under GDPR” section below. Your recorded calls will be processed by our subprocessor Gong Ltd., specified in the list of our subprocessors, who is bound to treat your personal information with utmost care and up to similar standard to our own.
Kontent Training and Certification Program
What data will be collected about you?
When you order or buy a Kontent training, Kontent will collect your data provided in the contract on the provision of the Kontent training (“Contract”) and in any other document made by you and Kontent in relation to the Contract, and furthermore the data which you provide to Kontent in relation to the performance of the Contract or the conclusion of the Contract. Collected data consist typically of contact details such as name, e-mail address, and phone number, and invoicing details such as your bank account number, training progress and results, certification progress, and results.
How will Kontent use the data it collects about you and for what purposes?
Kontent will use your personal data to perform its rights and obligations arising out of the Kontent Training and Certification Program.
Processing of your data for this purpose is necessary for the performance of the contractual obligations arising out of the Kontent Training and Certification Program within the meaning of sec. 6(1)(b) of the GDPR. For this purpose, the data will be processed until the termination of all the contractual obligations arising out of your participation in the Kontent Training and Certification Program. You have no legal obligation to provide the data, nevertheless, in that case, you cannot participate in the Kontent Training and Certification Program.
Events
What data will be collected about you?
If you attend a workshop or any other event organized by Kontent (“Event”), Kontent will collect information you provide when you sign up for the Event or during the Event. Collected data consists typically of basic contact details such as name, residence, company, telephone, and e-mail address.
How will Kontent use the data it collects about you and for what purposes?
Performance of the Event
- Kontent will use the data to organize the Event, to perform the Event, and to provide you with the necessary services related to the Event.
- Furthermore, Kontent may use the data in order to send you background papers and presentations from the Event, unless you let Kontent know by e-mail at [email protected] that you do not want these materials.
- Processing of your data for this purpose is necessary to perform the respective contractual obligations (and to take steps prior to entering into respective contractual obligations at your request) within the meaning of sec. 6(1)(b) of the GDPR. For this purpose, the data will be processed until the termination of all the respective contractual obligations. You have no legal obligation to provide the data, nevertheless, in that case, you will not be able to attend to any Event.
Evaluation of the Event
- Kontent may use your data also to evaluate the efficiency of the Event. For this purpose, Kontent may also match the collected data with other data that Kontent collects about you.
- Processing of your data for this purpose is necessary for the legitimate interests pursued by Kontent within the meaning of sec. 6(1)(f) of the GDPR. For this purpose, the data may be processed until the termination of all the respective contractual obligations and further for the next four years.
Use of your photographs
- If you explicitly give Kontent consent to use your photographs taken at the Event, Kontent may use the photographs to inform about the Event and anyhow promote the Event. For this purpose, the photographs may be published on Kontent’s websites or social media.
- Processing of your data for this purpose is based on your consent within the meaning of sec. 6(1)(a) of the GDPR. Your personal data will be used only for the duration of your consent. You may withdraw the consent anytime simply by letting us know by e-mail at [email protected]. You have no legal obligation to provide the data.

Your personal data will be processed by our trusted processors:
- Microsoft Corporation, with its registered office at One Microsoft Way, Redmond, WA 98052-7329, USA, a cloud computing services provider (Microsoft Azure Services), or its subcontractors (a list of the subcontractors is available at the following link https://aka.ms/Online_Serv_Subcontractor_List);
- Third parties specified in the document Personal Data in Kontent.ai or their subcontractors, who may process your data when you use the Kontent service.
Furthermore, your personal data may be handed over to Kontent’s providers of professional services such as attorneys at law, tax advisors and IT specialists who will be bound by the rules of professional confidentiality.
Your personal data will be kept within Kontent and the abovementioned third parties except where disclosure is required by law (e.g., government bodies), or except where disclosure is necessary to protect Kontent’s rights (e.g., courts).
Some of the above-mentioned companies in the Kontent Group and third parties are seated outside the European Union. Therefore, your personal data may be transferred outside the European Union. As Kontent is responsible for your personal data, it always ensures that your data remains protected and secure when being transferred. The applicable safeguards are in the form of standard contractual clauses approved by the European Commission.
Your rights under the GDPR
As a data subject, you have all the rights under the GDPR, specifically:
- the right to obtain confirmation from Kontent as to whether or not your personal data are being processed, and, where that is the case, access to the personal data and further information according to sec. 15 of the GDPR such as the purposes of the processing, the categories of personal data concerned, and the recipients or categories of recipient to whom the personal data have been or will be disclosed;
- the right to obtain the rectification of inaccurate personal data concerning you according to sec. 16 of the GDPR;
- the right to obtain the erasure of personal data under the circumstances set in sec. 17 of the GDPR, e.g., in case the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
- the right to obtain restriction of processing under the circumstances set in sec. 18 of the GDPR, e.g., you contest the accuracy of the processed personal data;
- the right to receive your personal data, which you have provided to Kontent, in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance from Kontent under the circumstances set in sec. 20 of the GDPR;
- the right to object to processing of your personal data based on legitimate interests pursued by Kontent (within the meaning of sec. 6(1)(f) of the GDPR) or to processing for direct marketing purposes, pursuant to sec. 21 of the GDPR.

Other aspects of the data processing
a) Using in order to protect Kontent’s rights and legitimate interests
Kontent may use your data also to avoid potential litigations against it and to defend its rights and legitimate interests (especially before courts) related to the purpose for which the data were processed specified in this Privacy policy (e.g., the performance of the Contract, or participation in the Kontent.ai Partner Program).
Processing of your data for this purpose is necessary for the legitimate interests pursued by Kontent within the meaning of sec. 6(1)(f) of the GDPR. For this purpose, the data may be processed for the period adequate to the relevant limitation periods, usually up to eleven years from the date when the last limitation period commences. This period suspends in case you assert any claim against Kontent related to the relevant purpose of processing of your data until the final decision of the court having jurisdiction in this case.
b) Data of contact persons
In case you hand personal data of your contact person, or any other third person, over to Kontent, please make sure that the personal data are handed over in compliance with GDPR. Specifically, please ensure that such person is duly informed that their personal data will be handed over to Kontent and for what purpose.
Kontent may use the personal data for the purpose they were handed over, typically to communicate with you in case of personal data of a contact person. Processing of the personal data is based on the legitimate interests pursued by Kontent within the meaning of sec. 6(1)(f) of the GDPR.
c) Data security
Any information you provide to Kontent is safeguarded and secure. To prevent unauthorized access, maintain data accuracy, and ensure the correct usage of information, Kontent has put in place appropriate physical, electronic, and managerial procedures.
Access to your personal information is restricted to those Kontent employees and external contractors who need to know that information in order to process it. These individuals are bound by confidentiality obligations and may be subject to disciplinary action, including job contract termination, if they fail to meet those obligations.
d) Third-party sites
On kontent.ai or its subdomains, you may find links to websites of third parties. These websites are independent of Kontent and Kontent is not liable for the privacy practices of these third parties. Kontent, therefore, encourages you to get familiar with their privacy policy, as it may differ from Kontent’s.
