Stephen Powell (Republican Party) was a judge of the Ohio Twelfth District Court of Appeals. He assumed office in 1995. He left office on February 8, 2025.
Powell (Republican Party) ran for re-election for judge of the Ohio Twelfth District Court of Appeals. He won in the general election on November 6, 2018.
Education
Powell received his undergraduate degree from Heidelberg College in 1977 and his J.D. from the University of Dayton School of Law 1981.[1]
Career
Powell served as a referee in the Butler County Domestic, Juvenile and Probate Courts from 1984 to 1989. He then became a judge for the Butler County Courts. In 1991, Powell joined the Butler County Probate Court. He held this position until he joined the Twelfth District Court of Appeals in 1995.[1]

Selection method
The judges of the Ohio District Courts of Appeals are selected through partisan primary elections followed by nonpartisan general elections.[4] Courts of appeals candidates are chosen in their respective appellate districts.[4] In the event of a midterm vacancy, the governor appoints a replacement. The appointee serves until the next general election taking place 40 or more days after the vacancy occurred. If re-elected, the judge serves the remainder of his or her predecessor's unexpired term.[4] In 2007, Governor Ted Strickland issued an executive order creating a judicial appointment recommendation panel to assist in making new appointments. The panel evaluates applicants and advises the governor, but the governor is not bound to the panel's recommendations.[4]
Qualifications
To serve on the court, a judge must be:
- a district resident;
- at least six years in the practice of law; and
- under the age of 70.[4]
Selection of the chief judge
The chief judge of the Ohio District Courts of Appeal is chosen by peer vote and serves for one year.[4]

Powell was re-elected to the Twelfth District Court of Appeals after running unopposed on November 6, 2012.[5]

Noteworthy cases
In re: Estate of Catherine De Saint-Rat
In 2008, Powell endorsed the seizure of a private estate by an Ohio institution and the subsequent suits brought by a lawyer then working as an assistant attorney general for the same institution. A careful examination of the three page will of the deceased did not mention the institution in question nor any other Ohio institution. The same panel of judges was hearing this same assistant attorney general argue various other institutional cases at the time. In the October 2007 oral argument, this judge clearly stated that an option to purchase cannot last 60 days. This oral argument was subsequently suppressed by the Twelfth District Court of Appeals.[6]
