The South Carolina Director of Labor, Licensing and Regulation is an appointed executive position in the South Carolina state government. This position oversees areas of state regulation including professional and occupational licensing, fire and life safety and labor.[1]

Current officeholder

The current officeholder is Emily Farr, who was appointed by Gov. Nikki Haley on August 8, 2016 and took office on March 8, 2017.[2] Farr succeeded Richele Taylor, who took office on February 12, 2015. Taylor replaced Holly Gillespie Pisarik, who served from 2012 to 2014.[3]

Authority

The South Carolina Director of Labor, Licensing and Regulation's office is derived from Title 40, Chapter 1, Article 1 of the South Carolina Code of Laws.

Article 1, Section 40-1-40:

(D) The Department of Labor, Licensing and Regulation is a member of the Governor's executive cabinet and must be headed by a director...[4]

Appointments

The authority of the South Carolina Director of Labor, Licensing and Regulation, with the director at its head, rests in Title 1, Chapter 30 of the South Carolina Code of Laws.[5]


(B)(1) The governing authority of each department shall be:

(i) a director or a secretary, who must be appointed by the Governor with the advice and consent of the Senate, subject to removal from office by the Governor pursuant to provisions of Section 1-3-240(B); or

Vacancies

As laid out in Title 1, Chapter 30 of the South Carolina Code of Laws, the director of Labor, Licensing, and Regulation is appointed by the governor with the advice and consent of the state Senate. In the event of a vacancy, the governor appoints a replacement. The South Carolina Code of Laws specifies what happens if a vacancy opens up while the General Assembly is not in session:


(F) In the event a vacancy occurs in the office of the department's governing authority at a time when the General Assembly is not in session, the Governor temporarily may fill the vacancy pursuant to Section 1-3-210.[6]

The mission of the Department of Labor, Licensing and Regulation (LLR) is to promote the health, safety and economic well-being of the public through regulation, licensing, enforcement, training and education.[7]
