The New York Public Service Commission (PSC) is an appointed board in the New York state government. The PSC is located within the Department of Public Service and the chair of the PSC serves as the chief executive officer of the department, which regulates electric, gas, steam, telecommunications, and water utilities in the state. The department also stimulates renewable energy resources for the benefit of consumers and employers.[2]

The PSC consists of up to seven members appointed by the governor.

The public service commission's authority, powers, and membership is derived from Article 1 of the Public Service chapter of the New York Laws.

PBS Article 1, Section 4:

There shall be in the department of public service a public service commission, which shall possess the powers and duties hereinafter specified, and also all powers necessary or proper to enable it to carry out the purposes of this chapter. The commission shall consist of five members ... A commissioner shall be designated as chairman of the commission by the governor ... No more than three commissioners may be members of the same political party ...[3]

According to Article 1, Section 9 of the Public Service chapter of the New York Laws, "No person ... shall hold the office of the commissioner ... who holds any official relation to any person or corporation subject to the supervision of the commission, or who owns stocks or bonds of any such corporation.[4]

Commissioners are appointed by the governor and confirmed by the New York State Senate. Commissioners appointed for a full term serve for six years following the first day of February of the year when he or she was appointed. Commissioners appointed to fill out the remainder of an unexpired term serve for the length of that unexpired term.[3]

Duties

The public service commission has jurisdiction over and is responsible for the regulation of electric, gas, steam, telecommunications, and water utilities in the state. The department also stimulates renewable energy resources for the benefit of consumers and employers. The commission may promulgate rules, hold hearings, and issue opinions relating to those utilities under its jurisdiction.[2]
